Get a public housing decision reviewed

If you disagree with public housing decision that affects you, you can ask us to check our decision and consider new information you have.

You can ask for a review of most Housing ACT decisions.

A review means we will:

  • check our decision
  • consider your reasons for asking for a review
  • consider any new information you have.

If you get a letter from us with a decision you don’t agree with, you have 28 days to ask us for a decision review.

Decisions you can get reviewed

You can ask us to review our decision if we don’t approve your application:

  • for housing
  • for a rental rebate
  • to transfer to another Housing ACT home.

You can also ask for a review:

  • of the housing waitlist category you’re in
  • if we decide you're no longer eligible for public housing.

Steps to get a review

1. Contact us

Talk to the staff member who made the decision. Ask them to explain their decision.

If you have new information or your circumstances have changed this could change their decision.

If you are not happy with their response, you can ask for a formal review of the decision. This is called a first level review.

2. Apply for a review

When you apply for a formal review, we call it a first level review.

You must apply for a review within 28 days of getting a letter from us with our decision. You will always get a letter from us explaining the decisions we make.

To apply for a first level review:

  1. Download and fill in the Application for Review of Decision form [PDF 182kB]. You can also get this form from Housing ACT.
  2. Email the form to Housing.CustomerService@act.gov.au or give it to us in person at Housing ACT.

On the form you must:

  1. Tell us the decision you want reviewed.
  2. Explain the reason you disagree with the decision.

After you apply

You’ll get a letter within 28 days of us receiving your form telling you:

  • if the decision has changed
  • explaining the reasons why.

If you’re unhappy with the result of the first level review, you can apply for a second level review.

3. Apply for a second review

We call this a second level review.

You must do this within 28 days of the date on Housing ACT’s written response to the first level review.

A senior staff member will review the decision.

They may:

  • change or agree with the decision
  • recommend other actions
  • ask for more information.

To apply for a second level review:

  1. Download and fill in the Application for Review of Decision form [PDF 182kB].
  2. Email the form to Housing.CustomerService@act.gov.au.

After the second review

You will get a letter explaining the result of the review.

If you still disagree with our decision

You can apply to the ACT Civil and Administrative Tribunal (ACAT) for an independent review. This is free for Housing ACT tenants.

Help to get a decision reviewed

If you need an interpreter, the ACT Government will pay for this. Ask the staff member you are dealing with to arrange an interpreter.
