YourSay Panel Terms of Use


The personal information we collect from you including demographic details and your email address will be stored with an overseas cloud service provider, Alida AU Pty Ltd (Alida), whose servers are based in Australia.

The following Terms of Use govern the ACT Government’s YourSay Panel (“Site”). The platform is owned and operated by Alida, on behalf of the Chief Minister, Treasury and Economic Development Directorate (CMTEDD).

By accessing and using the Site, you are choosing to accept and comply with the Terms presented throughout this agreement as well as the Privacy Notice. These Terms apply to all visitors and users of the Site. Linked sites, affiliated services or third-party content or software have their own Terms that you must comply with.

What are the conditions with a user’s account?

While using the Site, you must not violate any applicable laws and regulations. It is our duty to protect the confidentiality of content you provide on the Site in accordance with our Privacy Notice and applicable laws. If you register and create an account with us, you must always provide us with accurate information. Failure to provide accurate information violates the Terms of Use, which may result in immediate termination of your account. Unauthorised use of your account must be immediately reported to CMTEDD’s Privacy Contact Officer. In some limited cases, we or our agents, may require access to your user account to respond to technical issues.

If you want to terminate your own account and/or your involvement in the Site, you can unsubscribe via options available on the Site or via a link included on all emails sent from the Site.

Governing Law

These Terms shall be governed in accordance with the laws of the Australian Capital Territory and any applicable laws of the Commonwealth.

What content does the ACT Government own?

The Site contains the copyrighted material, trademarks, patents, trade secrets and other proprietary information (“Intellectual Property”) of Alida and its suppliers and licensors. ACT Government owns and retains all proprietary rights in the intellectual property. All intellectual property in the content of this Site including without limitation, text, software, source code, pages, documents and online graphics, photographs, sounds, audio, video and other interactive features, are owned by or licensed to CMTEDD.

Any original content that you submit or post on our site may be made available to the public in accordance with the Privacy Notice. Except for Intellectual Property which is in the public domain or for which you have been given written permission, you may not copy, alter, transmit, sell, or distribute any of the Intellectual Property.

Disclaimer and Warranties

You must agree that your use of the site is at your own risk. CMTEDD takes no responsibility for content published on the site that has been provided by the users of the Community. This includes links to third party websites which may be posted by users on this site from time to time.

We make no warranty that the site will meet your requirements or be uninterrupted or error-free. Any material that the user downloads through the site is done at their own risk and users are responsible for any damages to their computer system or loss of data.

As set out in the Terms of Access, CMTEDD is not soliciting or intending to solicit personal information or personal health information about third parties. Any such information received on this website may be removed by CMTEDD.

We are not responsible for your communications or dealings, including payment and delivery of goods or services, with a third party found via the platform used to support the Community. Any loss or damage incurred from those communications or dealings are solely between the user and the third party.

What happens if these Terms change?

We reserve the right to modify or replace these Terms at any time without notice. The most recent version of the Terms of Use can be seen on this page. By continuing to access or use this site after those revisions become effective, you agree and will comply with the revised terms.
