You must let us know when your ACT nominated visa is granted and when you expect to arrive in Canberra. Send an email to migration@act.gov.au and include a copy of your visa grant letter.
If your visa is not granted, the ACT will not, under any circumstances, appeal to the Administrative Appeals Tribunal against decisions by the Department of Home Affairs.
Monitoring program
You must contact us once you arrive in Canberra. We will send you regular business activity surveys to monitor how you are going with your planned ACT business activity.
Change of ACT business activity
You are required to undertake the business proposal that we approved. However, if you are thinking of changing your business activity, you must contact us and seek approval before starting any new business activity.
Education for dependents
If you have school aged children and you want to enrol them in an ACT Government public school (primary and high school), you will have to pay international student tuition fees.
ACT 188 nomination – Business innovation stream
The ACT Education Directorate (ACTED) may agree to waive the tuition fee for your children if you can prove that your ACT nominated business activity has been of economic benefit to the Territory for the last six months.
You must contact us first and request support of a waiver of the tuition fee. Email migration@act.gov.au and provide the following information:
- Documents to evidence ACT business investment.
- Evidence of ACT business activity for the last six months.
- Statement of economic benefit to the Territory.
- Documents to evidence settlement in Canberra (e.g. property lease / purchase and six months of bank statements).
If we agree, you will receive an email supporting the fee waiver. You may then approach ACTED and request a waiver of the tuition fee. If approved by ACTED, you will be exempt from paying the tuition for your children. If the request for tuition fee waiver is unsuccessful, you must pay full international student tuition fees.
ACT 188 nomination – Significant investment stream
The ACT Education Directorate will waive the international student tuition fees for your children as you have already demonstrated economic benefit via your investments in Canberra. .
Pathways for permanent residence
Your subclass 188 visa is valid for four years. If you wish to apply for permanent residence you must:
- Meet the Department of Home Affairs criteria for grant of a Business Innovation and Investment (permanent) (subclass 888) visa.
- Prove that you met your ACT nomination obligations.
