As part of the ACT Government's Open Government commitment, this document is a public summary of matters considered by Cabinet. It is not intended to be a detailed set of minutes and does not cover all matters considered by Cabinet. Among matters not covered are materials considered in the formation of the ACT budget, commercial and industrial matters under negotiation, as well as matters that would impact personal privacy, security and the ACT economy. Nothing in this document can be considered a waiver of the Government's executive privilege.

Direct Sale of Blocks 5, 6 and 10 and Part Block 9 Section 10 Tharwa to BJG Holdings Pty Ltd

Cabinet agreed that BJG Holdings Pty Ltd is eligible for a direct sale of Blocks 5, 6, 10 and Part Block 9 Section 10 Tharwa, in accordance with section 240 (1)(a) of the Planning and Development Act 2007.  Cabinet also agreed to the Land Development Agency processing the application for direct sale with a view to offering a Crown lease.

Justice and Community Safety Legislation Amendment Bill 2014 (No 2)

Cabinet agreed the Justice and Community Safety Legislation Amendment Bill 2014 (No 2) (the JACS Bill) include amendments that provide for minor and uncontroversial amendments to several other Acts and Regulations.  Cabinet agreed the Attorney-General may present the JACS Bill in the ACT Legislative Assembly during the September sitting period.  The Bill and explanatory statement will be available on the ACT Legislation Register following presentation.

Statute Law Amendment Bill 2014 (No 2)

Cabinet agreed the Statute Law Amendment Bill 2014 (No 2) include amendments that provide for minor and uncontroversial amendments to several Acts and Regulations, in particular the Health Records (Privacy and Access) Act 1997 and the Lifetime Care and Support (Catastrophic Injuries) Act 2014.  Cabinet agreed the Attorney-General present the Statute Law Amendment Bill 2014 (No2) in the ACT Legislative Assembly.  The Bill and explanatory statement will be available on the ACT Legislation Register following presentation.

Capital Metro – Ministerial Statement

Cabinet agreed to the Ministerial Statement on the Capital Metro Project and to the Minister for Capital Metro making the Ministerial Statement in the ACT Legislative Assembly during the September 2014 sitting period.  The Ministerial Statement will be available in Hansard.

Justice Reform Strategy

Cabinet noted the aims and processes for the development of a Justice Reform Strategy and agreed that the development of the Strategy be assisted by an advisory group consisting of members drawn from key directorates, criminologists and/or social scientists and representatives from the justice system. Cabinet agreed to the preparation of two sentencing bills to give effect to the government's decision to repeal periodic detention as a sentencing option from 2016-17, and to replace periodic detention with an appropriate non-custodial sentencing option.

Nature Conservation Bill 2014

Further to the exposure draft consultation on the Nature Conservation Bill 2013, and the ACT Legislative Assembly motion and subsequent Report tabled in the Legislative Assembly on the Draft Bill, Cabinet agreed a range of changes be incorporated into the Nature Conservation Bill 2014.  Cabinet agreed the Minister for the Environment present the Nature Conservation Bill 2014 in the ACT Legislative Assembly.   The Bill and the Explanatory Statement will be available on the ACT Legislation Register following presentation.

ACT Government Submission to the Productivity Commission's Draft Report – Childcare and Early Childhood Learning

Cabinet agreed to the ACT Government Submission in response to the Productivity Commission's Draft Report – Childcare and Early Childhood Learning.  The Productivity Commission's Draft Report was publicly released on 22 July 2014.  The ACT Government Submission will be published on the Productivity Commission's website as a public document following consideration by the Commission.

Environment Protection Amendment Bill 2014

Cabinet agreed to the preparation of legislation to amend the Environment Protection Act 1997 and Environment Protection Regulation 2005 to implement reforms resulting from the legislative review in 2012-2013.   Cabinet agreed to the Minister for the Environment presenting the Environment Protection Amendment Bill 2014 to the ACT Legislative Assembly during the September sittings.  The Bill and explanatory statement will be available on the ACT Legislation Register following presentation.

Ministerial Statement Delivering a Skilled Capital in a Modern Training Environment

Cabinet agreed to the Ministerial Statement on Delivering a Skilled Capital in a Modern Training Environment and to the Minister for Education and Training making the Ministerial Statement in the ACT Legislative Assembly during the September 2014 sitting period.  The Ministerial Statement will be available in Hansard.

Energy Efficiency (Cost of Living) Improvement Act 2012 Review Outcomes

Cabinet noted the Review of the Energy Efficiency (Cost of Living) Improvement Act 2012 and the proposed government response to the Review recommendations.  The Review will be tabled in the ACT Legislative Assembly during the September sittings and will be available in Hansard.

Appointments

    ACTEW Corporation Board

    Cabinet agreed to endorse the appointment of a non-Executive Director to the ACTEW Corporation Board, subject to consultation with the Standing Committee on Public Accounts and referral to the Voting Shareholders.

    ACT Place Names Committee 2014-17

    Cabinet agreed to endorse:

    • reappointment of the Surveyor-General of the ACT as fulltime co-chair of the ACT Place Names Committee
    • reappointment of six fulltime members
    • appointment of five new fulltime members
