Get information about a reportable conduct investigation

Your organisation may be able to get information to help keep a child or young person safe and protect their wellbeing.

Conduct that is reportable includes child abuse, child abuse convictions or misconduct toward children.

As part of the Reportable Conduct Scheme, ACT Government directorates must investigate claims of reportable conduct that involve their staff.

You may be able to get information about a report if it helps to keep a child or young person safe and protect their wellbeing.

Check if you can ask for information

You can ask an ACT Government directorate for information about an investigation if you are:

  • an ACT employer covered by the ACT Reportable Conduct Scheme (called a designated entity)
  • a child safety information sharing entity.

To ask for this information, you must either:

  • be the head of your organisation or have their written permission
  • be in a role or function that makes it clear you have the authority.

Information you can get

You can only get information connected to a current employee of your organisation. The information you ask for does not have to be about the employee.

The information could help you:

  • make a decision or an assessment
  • plan, begin or conduct an investigation
  • manage a risk
  • provide another service your organisation is responsible for.

You must say how the information will help with:

  • the matter you're investigating
  • the risk to a child or young person.

Information we can share

We can share information about:

  • a person who was found responsible for child abuse or neglect
  • a child.

We may share other relevant information on a case-by-case basis.

The type of information will be either:

  • protected – about the health, safety or wellbeing of a child or young person
  • sensitive – can include information about a person or child who is named in a report or an information source.

We will de-identify all sensitive information. This is to protect the identity of children and information sources.

Your legal responsibilities

When you get information from us, you must protect the identity of the child and information source.

Even though we de-identify the information, sometimes an identity can be inferred.

You must only use the information we give you for the reasons you told us.
