Guide for framing offences

Summary

This guide assists ACT Government officials to produce well-designed, clear and enforceable criminal offence provisions. It is used to:

• draft or amend offences including strict liability offences
• review or set criminal and civil penalties
• create infringement notices.

There are standard policies and laws that apply to the formation and interpretation of offences. Human rights law, common law and the Criminal Code 2002 apply to offences and are considered when drafting an offence.
