Native plants are protected under the Nature Conservation Act 2014.

In the ACT, you must have a licence to:

  • take certain plants or parts of plants
  • collect seeds and plants from unleased land
  • remove soil or stone from reserves
  • damage land in reserves
  • remove or damage a native tree or fallen timber from leased or unleased land
  • interfere with nests or things next to the nest of native animals
  • drive a vehicle on a management trail in a reserve.

Damaging land in a reserve

You must have a licence to damage land in a nature reserve, including destroying or removing clay, gravel, rock, sand, soil and stone.

You must have a licence to damage a native tree or take fallen timber from unleased or leased land.

Interfering with nests

To interfere with a nest or something in the immediate environment of a nest of a native animal, you must have a licence.

Drive a motor vehicle on a management trail in a reserve

In most reserves, it’s illegal to use a motor vehicle on a management trail without a licence.

You can apply for a licence to drive in a reserve for:

  • utilities management
  • approved research
  • government contract work.
