The ACT Freedom of Information Act 2016 (the Act) commenced on 1 January 2018. Under Section 23 of the Act, information about each Cabinet or Cabinet committee decision needs to be made publicly available.

All decisions of Cabinet (including committees and subcommittees) are subject to open access information requirements. These requirements do not extend to items where consideration of an issue does not amount to a decision. For decisions of the Budget Committee of Cabinet, agreement to the appropriation bill will be taken to be the only Cabinet Decision under the Open Access Information scheme.

Right of review

The decision to release is a reviewable decision as identified in Schedule 3 of the Act.
